The court case Fontaine v Saskatchewan (Attorney General) took place following the 2014 contention by the Corporation of Catholic Entities Party to the Indian Residential School Settlement (CCEPIRSS) that it had reached a new settlement agreement with Canada regarding Indian Residential Schools. CCEPIRSS asserted it had come to the agreement during negotiations over Canada’s 2013 Request for Direction (RFD #1), in which Canada questioned CCEPIRSS’ deduction of its legal fees from its financial payments under the original Settlement Agreement (2006). When Canada disagreed with CCEPIRSS’ contention that a new agreement had been reached, CCEPIRSS filed its own Request for Directions (RFD #2) to enforce settlement.

On June 3, 2015 the Honourable Mr. Justice N.G. Gabrielson heard the Request for Direction filed by CCEPIRSS and the Catholic Entities. In this decision, Justice Gabrielson concludes "that there is an enforceable settlement of all issues between these parties relating to CCEPIRSS’ obligations under the Settlement Agreement". In so doing, CCEPIRSS was released from its original obligations under the Indian Residential Schools Settlement Agreement (2006) upon a payment of $1.2 million to Canada.
