Neil G. Gabrielson

Description
The Honourable Mr. Justice Neil. G. Gabrielson is a judge on the Court of Queen’s Bench for Saskatchewan. He received a Bachelor of Laws from the University of Saskatchewan in 1971 and was admitted to the Saskatchewan Bar in 1972. He was appointed a judge of the Court of Queen’s Bench of Saskatchewan on November 16, 2005. Gabrielson was the presiding judge at the 2015 court case between the Corporation of Catholic Entities Party to the Indian Residential School Settlement (CCEPIRSS) and the Government of Canada, Fontaine v Saskatchewan (Attorney General), 205 SKQB 220. In 2013, Canada had sought clarity on the Catholic Corporation’s implementation of the 2006 Indian Residential Schools Settlement Agreement, specifically, CCEPIRSS’ deduction of its legal fees from its financial payments. During the subsequent negotiations, CCEPIRSS came to believe that they had forged a new settlement with Canada. Canada denied this and the matter went to the courts. In 2015, Justice Gabrielson found in favour of CCEPIRSS and the Catholic entities were absolved of all further legal and financial obligations under the 2006 Settlement Agreement. Gabrielson also heard the 2021 request made by the Canadian Broadcasting Corporation and The Globe and Mail seeking access to the files from the 2015 court case.
