2015 Court Case Decision

Court case between CCEPIRSS and Canada

Description
CCEPIRSS' Request for Directions went to the Court of Queen’s Bench for Saskatchewan. Justice Neil Gabrielson ruled in favour of CCEPIRSS (Fontaine v Saskatchewan (Attorney General), 2015 SKQB 220). He stated that an enforceable settlement had been reached between the Catholic entities and Canada during negotiations over Request for Direction #1, and that, with the $1.2 million, CCEPIRSS was released from any further obligations under the original Settlement Agreement, including the fund-raising campaign. Since, under that Settlement Agreement, the financial obligations of the Anglican and United Churches were based on the outcome of the fundraising campaign, their obligations were reduced by three million dollars. The 2015 court case files were not made available to the public.
