T.W.N.A. v. Canada

Description
In T.W.N.A. v. Canada, 2001, the trial judge awarded the plaintiffs, who had attended St. George’s Indian Residential School in the 1960s, damages ranging from $159,000 to $185,000 (T.W.N.A. v. Canada, 2001 BCSC 1177 (Aleck)). In the Appeal, the judge eschewed  "vicarious responsibility" in assigning damages and instead cited "identification theory," arguing that the defendant's abuse had reflected that of a representative of the Anglican Church and Canada, namely the principal, who had also engaged in abuse.
